Too good to be true?

October 13, 2011 SuAnne Bryant

Getting a divorce without ever going to court may seem too good to be true, but as I am learning in my collaborative law training, not only is it true, it is simply the only sane way to handle what often seems like an insane situation.

I am a litigator and enjoy battling it out in the courtroom, but I have always felt that divorces should not be handled in this way. Litigators often used scorched earth tactics and a judicially imposed solution fails to address the emotional aspects of the divorce. In reality, there are three components to a divorce: legal, financial, and emotional. Litigation, and even mediation, does not address the emotional aspect. I am looking forward to completing my training and becoming a collaborative divorce practitioner. I am confident that once divorcing couples learn about it, they will wonder why anyone would ever get divorced in court.
